The state of Montana has dealt another blow to Biden’s now-struggling federal vaccination mandate. News announced by Montana Governor Steve Daines:

“BIG news for Montana,” Daines wrote on Twitter. “Joe Biden’s abuse of vaccine authorization threatens Montana hospitals, Montana health care workers, and Montanans seeking access to essential care. We must continue this fight.”
Governor Daines responded to an announcement from Montana’s Attorney General, Austin Knudsen.
“Good news for health care workers in Montana: A federal judge just approved our request for a ban on the CMS #mandate vaccine. This illegal mission has now been blocked in all 50 states.”
The news was announced by the Montana Department of Justice.
“The US District Court judge approved Montana Attorney General Austin Knudsen’s request for a preliminary order against the COVID-19 CMS vaccine authorization, which is set to go into effect Monday, December 6. 2021,” wrote the Montana DOJ. “The vaccine mandate remains in Montana and all other states for now.”
In response, Attorney General Knudsen issued the following statement.
“Over the past weeks, I’ve heard from health care workers across our state whose jobs are at stake if they fail to comply with President Biden’s excessive federal mandate.” Attorney General Knudsen said. “With CMS authorization now blocked in Montana until the case is decided, healthcare facilities have no reason to threaten their staff if they don’t get vaccinated.”
“The judge ordered and restricted the U.S. Department of Health and Human Services and the Centers for Medicare and Medicaid Services, along with their directors, employees, Administrators, and Clerks, from performing CMS duties. to all health care providers, providers, owners, employees, and everyone else it tries to cover up,” noted the Montana DOJ.
“In a pandemic like this, it is even more important to protect the separation of powers enshrined in our Constitution to avoid eroding our liberties,” said US District Judge Terry A. Doughty wrote in command. “The liberties of the unvaccinated demand no less.”
“The original order will remain in effect pending the final resolution of this case or until further orders are obtained from the United States District Court for the Western District for the Western District of Louisiana, the United States Court of Appeals for with Fifth Street or the Supreme Court of the United States,” Montana DOJ added.
The Montana case’s nationwide ban represents another devastating blow to Biden’s federal vaccine mandate. While the previous order from the Centers for Medicare and Medicaid Services applies to ten states, the ruling makes clear that it now applies to all 50 states.
