Kavanaugh and Amy Coney Barrett — who have been a part of the courtroom’s five-justice majority that allowed the regulation to take impact Sept. 1 — appeared extra swayed by arguments that the regulation improperly blocked the judicial evaluation obligatory when constitutional rights are at stake.
