Philadelphia prosecutors have filed a petition seeking to revoke the bail of Joshua Macias, a right-wing activist who lied that the 2020 election was stolen from Donald Trump, after when The Daily Beast reported that he appeared to be in breach of his bail conditions.
A spokesperson from the DA office confirmed that The Daily Beast‘S reported announcing their decision to seek bail in a case that began with Macias’ ill-fated trip to the Philadelphia Convention Center on November 5, 2020. Prosecutors said Macias was arrested by Philadelphia police while carrying a 40-caliber pistol with Anthony Lamotta, a member of the Vets 4 Trump, who was openly carrying a 9mm handgun. Side. The Philadelphia DA’s office alleges that both intended to interfere with the vote being conducted by the Philadelphia Board of Elections as soon as Joe Biden was set to claim the state and win the Electoral College. Macias was released on bail on December 5, 2020, but a month later, speaking at the “Freedom Rally” in the park next to the US Capitol in Washington, DC, on January 6, 2021 .
According to the filing, Macias and his accomplice Lamotta “participated in the uprising on the United States Capitol.” There is no evidence that any of them entered the Capitol building.
Later that month, prosecutors filed a motion to recall Macias’ based on his recent conduct. Macias’ bail conditions were increased, including restrictions on posting on social media or participating in protests, but he was not denied bail at the time.
The latest DA office filings cite a number of cases where Macias allegedly violated those updated bail conditions, including a March 8, 2022 live stream of a “protest of truck driver” outside Washington, D.C., “apparently recorded and narrated by Macias.”
“Indeed, Macias’ distinctive voice can be heard throughout and he identifies himself as ‘JM’ for about six minutes in the video. As a result, Macias not only posted on social media, but also posted a video of himself participating in a protest — both barred by bail conditions — and the attempt to disguise himself in the video as “JM” was evidence shows that he was aware that he was violating the conditions of his bail,” the filing reads.
First Kristofer Goldsmith, a senior member of the Innovation Lab at the Human Rights advocacy group First, who has been tracking his increasingly radical behavior for several years.
As The Daily Beast first reported, citing research by Goldsmiths, Macias has been consistently active on social media in recent weeks.
Goldsmith told The Daily Beast: “Today’s filing demonstrates the role that everyday Americans play in working with justice systems to hold people accountable for trying to destroy the American Constitution and everything it represents. “Anti-fascism is a daily occurrence in this country, and my team at Sparverius and the Innovation Lab at Human Rights First are just a small part of the active resistance against those who seek to subvert the our institutions and replace them with an autocrat.”
Macias’ attorney, William Brennan, was contacted but could not be reached for comment prior to the publication of this story. Attempts to reach Macias were not immediately successful.
