11th Circuit Court Reverses Itself from Earlier Ruling, Hands DeSantis Victory Against CDC

The State of Florida’s objections to the CDC’s cruise ship guidelines will remain…for now.

Reuters reported: “A federal appeals court late Friday reversed course and left a lower court order barring the U.S. Centers for Disease Control and Prevention (CDC) from enforcing the restrictions. coronavirus-related illness on a cruise ship in Florida,” Reuters reported.

The decision came after the State of Florida asked the US Supreme Court to limit CDC restrictions.

“The state of Florida on Friday asked the Supreme Court to limit restrictions on excursions imposed by the Centers for Disease Control and Prevention, days after a lower court issued a decision. remove those restrictions,” NBC reported.

“The rules have prevented the yachting industry from returning to full activity as the nation is recovering from the Covid-19 pandemic. The report continues that in the early stages of the public health crisis, cruise lines suffered several high-profile disease outbreaks. “This industry is one of the hardest hit by the coronavirus.”

“A federal district court in Florida sided with the state last month in response to the lawsuit brought by Ashley Moody, the Republican attorney general,” the report added. “On Monday, the 11th U.S. Court of Appeals temporarily halted that decision, allowing CDC rules to remain in place.”

Steve Vladeck, a research fellow at the University of Texas, comments on the oddity of this case.

“Well, this is… odd,” Vladeck said. “Eleventh Circuit, on its own, reversed its decision from Saturday night and brought *back* to issue a district court order against the CDC cruise ship restrictions. Earlier today, Florida asked #SCOTUS to rescind the Court of Appeals. “

Steven Mazie of The Economist commented on the ruling.

“Like [Steve Vladeck] note, the same 11th circuit that allowed CDC registries to be maintained in place, changed its mind today,” commented Mazie. “So it looks like the emergency application for SCOTUS is being debated and now the Biden administration could come knocking on Justice Thomas’s door.”

On Thursday, DeSantis announced its objection to the CDC’s guidance on mask-wearing for unvaccinated children. “We don’t do that in Florida, okay?” DeSantis said.
